OVERVIEW

FIV20 Vilified Apparel LLC (“FIV20,” “we,” “us,” or “our”) operates this website and store, including related products, content, features, and services (the “Services”). Our store is powered by Shopify.

These Terms of Service (“Terms”) govern your use of our Services and purchases from our store. By accessing our Services or placing an order, you agree to these Terms.

Our Privacy Policy explains how we handle personal information. Purchases are also subject to our Return and Refund Policy and Shipping Policy.

Nothing in these Terms limits consumer rights that cannot lawfully be waived or excluded.

1. ELIGIBILITY AND ACCOUNT INFORMATION

You must be at least the age of majority where you live to place an order, or have authorization from a parent or legal guardian.

You agree to provide accurate, complete, and current contact, payment, shipping, and order information.

If you create an account, you are responsible for protecting your login credentials and promptly notifying us of suspected unauthorized use. You may not use another person’s account or payment method without permission.

2. PRODUCTS AND DESCRIPTIONS

We make reasonable efforts to describe and display products accurately. Colors and appearance may vary because of screen settings, materials, printing methods, and production processes.

Product availability, descriptions, and prices may change. Changes do not alter an order we have already accepted unless you agree or applicable law permits otherwise.

Minor production variations do not excuse delivery of a defective product or a product that materially differs from its description.

We may limit quantities or discontinue products. Purchases are for personal use unless we provide written authorization for wholesale or commercial resale.

3. ORDERS AND PAYMENT

Placing an order is an offer to purchase. An automated order acknowledgment confirms receipt of your order and does not necessarily constitute acceptance.

We may decline or cancel an order for reasons such as product unavailability, suspected fraud, payment problems, or a material pricing or listing error, subject to applicable law.

If an issue affects your order, we will contact you using the information provided at checkout. If we cancel an order after collecting payment, we will refund the amount charged for the canceled items and any applicable associated charges.

You authorize the applicable payment processor to charge your selected payment method for the total shown at checkout.

4. PRICES, TAXES, AND PROMOTIONS

Prices and available discounts are shown on our website. Applicable taxes and shipping charges are displayed at checkout.

The price confirmed for an accepted order will not change because of a later price adjustment.

Promotions may have separate eligibility requirements, expiration dates, or exclusions. Any specific promotional terms apply to that promotion.

If international shipping is offered, any customer responsibility for customs duties, import taxes, or similar charges will be disclosed before purchase where required.

5. PROCESSING, SHIPPING, AND DELIVERY

Standard orders are generally prepared and shipped within three to five business days. Business days are Monday through Friday, excluding holidays.

Custom-order processing begins after payment, any required final design approval, and receipt of the information needed to complete the order. Different processing estimates for custom, made-to-order, or preorder products will be stated on the applicable product page or agreed upon before purchase.

Processing time is separate from carrier transit time. Estimated delivery dates are not guarantees unless expressly stated otherwise.

If we cannot ship within the promised timeframe, we will notify you, provide a revised estimate, and offer any delay, cancellation, and refund options required by applicable law.

Customers are responsible for providing a complete and accurate shipping address. Contact us immediately if an address needs correction. Changes cannot be guaranteed once processing begins.

Additional shipping charges may apply when an order must be resent because the address supplied was incorrect or incomplete, except where prohibited by law.

6. CANCELLATIONS, RETURNS, AND REFUNDS

Orders generally cannot be canceled or changed after placement because processing or production may begin immediately. Contact customersupport@fiv20.com promptly if you need assistance. We cannot guarantee that a requested change can be accommodated.

Eligible standard returns must be requested within three calendar days after the carrier marks the order as delivered, as described in our Return and Refund Policy.

Custom, personalized, made-to-order, digital, gift-card, clearance, and final-sale products are not eligible for voluntary returns or exchanges.

These restrictions do not limit rights concerning damaged, defective, or incorrect goods, shipping delays, or other circumstances covered by applicable law.

7. CUSTOM ORDERS AND DESIGN APPROVAL

Customers are responsible for providing accurate names, wording, dates, sizes, quantities, images, and personalization instructions.

When we provide a design proof, review it carefully before approving it. Approval confirms acceptance of the details reasonably shown in the proof, including spelling, layout, and placement.

We are not responsible for customer-provided errors accurately reproduced in an approved design. This does not excuse our failure to follow the approved design or supply a product that meets applicable legal requirements.

Minor differences between digital proofs and finished products may occur because of screen settings, materials, printing methods, and manufacturing processes.

Requests made after approval may affect pricing or completion time. We will communicate any proposed additional charges before proceeding.

8. CUSTOMER-SUPPLIED ARTWORK AND MATERIALS

By submitting artwork, photographs, logos, names, or other materials, you confirm that you have the rights or permission needed for us to use them to fulfill your order.

You grant FIV20 a limited license to reproduce, adapt, and use those materials as reasonably necessary to design, produce, and fulfill the requested order.

This permission does not, by itself, authorize us to publish your photographs or custom-order materials for marketing.

We may refuse materials that reasonably appear unlawful, infringing, threatening, or otherwise inappropriate for our Services.

You retain rights you hold in your submitted materials. Unless otherwise agreed in writing, FIV20 retains its rights in original artwork created by FIV20. Purchasing a finished product does not automatically transfer editable files, source files, or reproduction rights.

9. INTELLECTUAL PROPERTY

Content owned by FIV20, including our branding, original designs, text, graphics, photographs, and website materials, is protected by applicable intellectual property laws.

You may use the Services for personal shopping and other lawful purposes. You may not reproduce, sell, distribute, or commercially exploit protected materials without permission, except as permitted by law.

Shopify and other third-party names, logos, and materials belong to their respective owners.

10. REVIEWS AND FEEDBACK

If you submit a review or other public feedback, you grant us a nonexclusive, worldwide, royalty-free license to display, reproduce, and use it to operate and promote our Services.

This license does not transfer ownership of your content or apply to private customer-support messages or custom-order materials.

Reviews must reflect your honest experience. Disclose any incentive or material relationship where required.

You must not submit unlawful content, impersonate another person, or include another person’s private information without authorization.

We may moderate content for spam, abuse, privacy violations, or other legitimate reasons. We do not prohibit honest negative reviews or require customers to waive rights to provide them.

11. MARKETING COMMUNICATIONS

Where offered, you may choose to subscribe to promotional emails or text messages.

Marketing text messages require your express opt-in. Consent is not a condition of purchase. Message frequency varies, and message and data rates may apply.

Follow the unsubscribe instructions in the messages, including replying STOP where supported. For help, contact customersupport@fiv20.com.

Opting out of marketing does not prevent necessary communications about your orders or account.

Our Privacy Policy explains how we handle information used for communications and advertising.

12. PROHIBITED USES

You may not use the Services to:

• Violate applicable law or another person’s rights.

• Submit fraudulent orders or unauthorized payment information.

• Harass, threaten, or impersonate another person.

• Upload malicious software or interfere with the operation or security of the Services.

• Access accounts, systems, or nonpublic information without authorization.

• Collect personal information about others without a lawful basis.

• Copy or exploit protected content without permission.

• Send spam or use automated tools in a way that disrupts the Services or bypasses access controls.

We may restrict access when reasonably necessary to address unlawful activity, fraud, security threats, or material violations of these Terms.

13. THIRD-PARTY SERVICES AND LINKS

Our Services may include links, payment services, or other tools operated by third parties.

Those services may have their own terms and privacy policies. Review them before using the relevant service.

We are responsible for our own obligations concerning purchases from FIV20. Third-party involvement does not remove rights you have against us under applicable law.

14. RELATIONSHIP WITH SHOPIFY

Shopify provides the platform that powers our store. Purchases from this store are transactions between you and FIV20 Vilified Apparel LLC.

FIV20 is responsible for its products, order fulfillment, customer service, and obligations to customers. Shopify’s services are governed by its applicable terms and policies.

15. PRIVACY

Our collection and use of personal information are described in our Privacy Policy.

Shopify also processes information in connection with hosting our store and providing its services. Learn more in the Shopify Consumer Privacy Policy.

Acceptance of these Terms does not replace any separate consent required for marketing or non-essential tracking.

16. ERRORS AND CORRECTIONS

We may correct typographical errors, inaccurate descriptions, or other mistakes on our website.

If a material error affects an order you placed, we will contact you before making a change that requires your agreement. If the order is canceled, we will refund the applicable amount collected.

Corrections do not limit remedies available under applicable law.

17. SERVICE AVAILABILITY AND WARRANTIES

We aim to keep the Services accurate, secure, and available, but interruptions and errors may occur.

To the extent permitted by law, website features and content are provided on an “as available” basis without guarantees of uninterrupted or error-free operation.

Nothing in these Terms excludes mandatory product warranties or guarantees, excuses misleading product descriptions, or limits rights concerning defective or nonconforming goods.

18. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, FIV20 is not liable for indirect, incidental, special, or consequential losses arising from use of the Services where those losses may lawfully be excluded.

This limitation does not apply to fraud, willful misconduct, gross negligence, or any liability that cannot lawfully be limited or excluded. It does not eliminate your right to an applicable refund, replacement, or other mandatory remedy.

19. SUSPENSION AND TERMINATION

We may suspend or terminate access to an account or the Services for a material violation of these Terms, suspected fraud, or a security threat.

Where appropriate, we will provide notice and an opportunity to resolve the issue.

Suspension or termination does not eliminate obligations relating to accepted orders, refunds, or rights that arose before termination.

20. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of the State of Arizona and applicable United States federal law, without overriding mandatory consumer protections that apply where you live.

Subject to applicable law, disputes may be brought in the state or federal courts located in Pima County, Arizona. This provision does not restrict a consumer’s right to bring a claim in another court where applicable law provides that right.

21. GENERAL TERMS

If a provision of these Terms is found unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

Our failure to enforce a provision immediately does not waive our right to enforce it later.

These Terms and the policies incorporated by reference govern your use of the Services, together with any specific written terms agreed upon for your order.

22. CHANGES TO THESE TERMS

We may update these Terms to reflect changes to our Services or legal requirements. Updated Terms will be posted with a revised “Last updated” date.

Changes apply prospectively and do not retroactively alter accepted orders unless you agree or applicable law permits otherwise. We will provide additional notice where required.
